Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the Somemind platform ("Service"), operated by Punasaari Research, located in Vantaa, Finland ("we", "us", "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Service Description

Somemind is an AI-powered social media management platform that enables users to create, schedule, and publish content across Instagram, Facebook, and TikTok. The Service includes:

  • AI-generated captions, images, and videos
  • Automated content scheduling and publishing
  • Trend tracking and analytics
  • Multi-workspace and team collaboration
  • Media library and content management

3. Account Registration

  • You must be at least 18 years old to use the Service.
  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • One person or entity may not maintain more than one free trial.

4. Subscription and Payments

4.1 Plans

The Service offers four subscription tiers: Starter, Growth, Scale, and Agency. Each plan includes specific usage limits as described on our pricing page.

4.2 Billing

  • Subscriptions are billed monthly or annually in EUR (€).
  • Payments are processed securely by Stripe.
  • Annual subscriptions receive a discount equivalent to 2 months free.
  • All prices are exclusive of applicable VAT unless stated otherwise.

4.3 Free Trial

  • The Starter plan includes a 7-day free trial.
  • Trial extensions may be offered via promotional codes.
  • You will be notified 3 days before your trial expires.
  • If no payment method is provided after the trial, access to workspace features will be restricted.

4.4 Cancellation and Refunds

  • You may cancel your subscription at any time through the billing settings or Stripe portal.
  • Cancellation takes effect at the end of the current billing period.
  • We do not provide prorated refunds for unused portions of a billing period.
  • If payment fails, you have a 7-day grace period to update your payment method before access is suspended.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws.
  • Generate or publish content that is defamatory, hateful, violent, or sexually explicit.
  • Impersonate any person or entity.
  • Attempt to circumvent usage limits, rate limits, or security measures.
  • Use automated tools (bots, scrapers) to access the Service beyond the provided APIs.
  • Share your account credentials with unauthorized users.
  • Upload malware, viruses, or other harmful files.
  • Resell or sublicense the Service without an Agency plan and written agreement.

6. AI-Generated Content

  • Content generated by our AI is provided "as is". You are responsible for reviewing and approving content before publication.
  • We do not guarantee that AI-generated content is factually accurate, free from errors, or suitable for any particular purpose.
  • You retain ownership of content you create using the Service.
  • You grant us a limited license to process your content for the purpose of providing the Service.
  • AI-generated images and videos are for your commercial use. We do not claim ownership of generated media.

7. Social Media Platform Compliance

  • You are responsible for complying with the terms of service of connected social media platforms (Meta, TikTok).
  • We act as your authorized agent when publishing content on your behalf.
  • We are not responsible for account suspensions or restrictions imposed by third-party platforms.
  • You must ensure you have the necessary rights and permissions for all content published through the Service.

8. Intellectual Property

  • The Somemind platform, including its software, design, and documentation, is the intellectual property of Punasaari Research.
  • You may not copy, modify, distribute, or reverse engineer any part of the Service.
  • The Somemind name, logo, and branding are trademarks of Punasaari Research.

9. Data Protection

Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect, use, and protect your data. For GDPR-specific information, see our GDPR page.

10. Service Availability

  • We aim for 99.9% uptime but do not guarantee uninterrupted service.
  • We may perform maintenance with reasonable advance notice.
  • We are not liable for downtime caused by third-party services (Supabase, Stripe, social media platforms).

11. Limitation of Liability

  • The Service is provided "as is" without warranties of any kind.
  • To the maximum extent permitted by law, our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
  • We are not liable for indirect, incidental, or consequential damages, including lost profits, lost data, or business interruption.

12. Termination

  • We may suspend or terminate your account if you violate these Terms.
  • You may delete your account at any time via Settings > GDPR > Request Account Deletion.
  • Upon termination, your data will be deleted within 30 days, except where retention is required by law.

13. Governing Law

These Terms are governed by the laws of Finland. Any disputes shall be resolved in the courts of Helsinki, Finland.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance.
